BEEM Technologies Inc. ("BEEM", "we", "our", "us") is a Montreal-based company that offers a fully managed, end-to-end platform for organizations to organize, transform and analyze their data (the "BEEM Data Platform").

This Privacy Policy (the "Policy") explains how BEEM collects and uses Personal Data (as defined below) in connection with the BEEM Data Platform, available at https://app.beemdata.com/.

BEEM serves organizations across Canada, the United States and internationally, from various sectors and jurisdictions. Organizations ("Clients") use the BEEM Data Platform for all or part of their data ("Client Data"), which may include Personal Data of their own employees, contractors, clients, customers and other third parties, as solely determined by them.

Personal Data BEEM Collects

"Personal Data" is any information relating to an identified or identifiable natural person as defined in applicable laws and regulations, including the Act respecting the protection of personal information in the private sector (Québec) ("Law 25"), the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA"), the laws of the United States of America and its states, and, where applicable, the EU General Data Protection Regulation ("GDPR").

Account Personal Data

Client Personal Data

The BEEM Data Platform ingests and processes the data submitted by Clients, which may include Personal Data. The Client, as controller, determines which data is submitted to the Platform and is responsible for the lawfulness of its collection, including any required consents. BEEM processes Client Personal Data exclusively to provide the contracted services, in accordance with the Client's instructions, the Terms of Service and, where executed, BEEM's Data Processing Addendum.

BEEM maintains the security and confidentiality of all Client Data ingested by the BEEM Data Platform.

When Clients' authorized users connect to the BEEM Data Platform, we collect:

Artificial Intelligence Features

The Platform's AI features are deployed within each Client's dedicated cloud environment. Client Data processed by AI features remains within that environment and is not transmitted to third-party AI model providers outside of it. BEEM does not use Client Data to train artificial-intelligence models. BEEM may use anonymized, aggregated usage information about AI features (such as categories of questions asked) to improve its services; this information never includes the content of Client Data.

The Platform does not make any decision based exclusively on automated processing that produces legal effects concerning individuals; the AI features produce analyses that humans evaluate.

Integrations

The BEEM Data Platform integrates with third-party applications selected and activated by Clients. When a Client authorizes an integration or connects an external tool to its environment - for example a business-intelligence tool, an external AI service or an MCP-based client - data, potentially including Personal Data, flows out of the Platform to that third party at the Client's direction and under the Client's control, and may transit the Internet or be processed and stored by that third party under its own terms. This is distinct from the Platform's native features (including its AI features), where data remains within the Client's dedicated environment. The Client, as controller, is responsible for ensuring that such transfers comply with applicable privacy legislation, including obtaining any required consents. BEEM offers network connectivity options to help secure external connections, and Clients should consult BEEM's team for guidance appropriate to their security requirements. BEEM binds its own suppliers to confidentiality and data protection obligations, but does not control, and is not responsible for, the privacy practices of third-party applications chosen by the Client.

How We Use Account Personal Data

We may record or transcribe video-conference calls in which you participate - for example during sales conversations, onboarding, support and professional services engagements - to document requirements, keep accurate records of what was discussed, and improve our services. When a call is audio- or video-recorded, the recording tool is identified as a participant in the meeting or the recording is otherwise announced, giving you the opportunity to object or turn off your camera. We may also use note-taking tools that generate a text transcription or summary of a meeting without recording audio or video. If you prefer not to be recorded or transcribed, let us know at the start of the meeting. Recordings and transcriptions are retained as described in this Policy.

BEEM discloses Personal Data when cooperating with regulatory and government authorities as required by applicable legislation.

How We Use Client Personal Data

BEEM is a service provider (processor) to its Clients. BEEM uses Client Personal Data only to:

BEEM does not sell Client Personal Data and does not retain it longer than required by its contractual obligations or applicable law.

Personal Data of Minors

The BEEM Data Platform is a business tool intended for professional users. BEEM does not offer its platform and services to minors and does not knowingly collect Personal Data of individuals under the age of 18.

Who We Share Personal Data With

We use third-party service providers to deliver our services. BEEM's service providers are contractually obligated to use Personal Data only for the specific purposes of performing the contracted services, to protect it, not to sell it, and not to disclose it without our authorization.

Annex C of the Data Processing Addendum is the authoritative and up-to-date source for the list of subprocessors; the table above is provided for information purposes.

We may share Personal Data in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business. In this event, you will be notified of any change in ownership or uses of your Personal Data.

We may share anonymized or aggregated data which cannot, directly or indirectly, be used to identify individuals.

International Transfers of Personal Data

Personal Data is collected, transferred to, stored and accessed in Canada and the United States. Client Data is hosted in the AWS region corresponding to the Client's location or preference - for example, Canadian Clients in AWS Canada (ca-central-1) and U.S. Clients in a U.S. AWS region - so that Client Data can reside in the Client's own jurisdiction. Where Personal Data subject to Law 25 is communicated outside Québec, BEEM conducts the assessment required by Law 25 and ensures the data receives adequate protection, including through contractual safeguards. Where Personal Data of EU/UK individuals is transferred outside the EEA or UK, we rely on Standard Contractual Clauses or another lawful transfer mechanism.

Data Security and Retention

Your Personal Data is kept secure. Only authorized employees, agents and contractors bound by confidentiality obligations have access to it. We and our service providers use industry-standard security measures, maintained under BEEM's information security program, which follows SOC 2-aligned processes. In addition, BEEM is an AWS Partner whose platform has passed the AWS Foundational Technical Review (FTR) as a validated independent software vendor, and is an AWS authorized distribution reseller - programs that impose independent technical and security requirements reviewed by AWS. A description of BEEM's information security program is available to Clients on request.

BEEM retains Personal Data for the period necessary to fulfill the purposes outlined in this Policy or until deletion is requested, unless a longer retention period is required by applicable law. Our retention criteria are as follows: Account Personal Data is retained for the duration of the contractual relationship, plus 7 years for financial records; Client Data is retained in accordance with the contract and section 19(c) of the Terms of Service. BEEM deletes or returns Client Data upon termination of its contractual obligations, as instructed by the Client and as set out in the Terms of Service.

Even if you opt out of marketing communications, we may still contact you about security and privacy issues, account servicing and your requests.
