BEEM Technologies Inc. ("BEEM", "we", "our", "us") is a Montreal-based company that offers the BEEM Data Platform.

This Website Privacy Policy (the "Policy") explains how BEEM collects and uses Personal Data (as defined below) of visitors to its marketing website https://www.beemdata.com/ (the "Site").

Personal Data BEEM Collects

"Personal Data" is any information relating to an identified or identifiable natural person as defined in applicable laws and regulations, including the Act respecting the protection of personal information in the private sector (Québec) ("Law 25"), the Personal Information Protection and Electronic Documents Act (Canada), the laws of the United States of America and its states, the EU General Data Protection Regulation ("GDPR") and applicable United Kingdom legislation.

Our Site uses cookies, UTM tags, advertising identifiers, pixels and similar technologies to automatically collect information from visitors, as further described in our Cookie Policy.

In accordance with Law 25, non-essential technologies that allow us to identify, locate or profile you are disabled by default and are activated only with your consent, expressed through the cookie banner on the Site; you may withdraw that consent at any time through the banner.

We collect system information such as IP address, browser and OS type, domain name, date and time of visit, pages viewed and links clicked. Random user identifiers are associated with IP addresses to recognize actions from the same visitor. We generally cannot identify you personally from this information unless:

Information from third parties

We may collect information from public sources and from third-party providers of business contact information (such as job titles and business emails) for purposes of targeted advertising, relevant email content, event promotion, sales, marketing and business intelligence. Upon request, BEEM will inform you of the source of the Personal Data collected about you from third parties.

If you apply for a position advertised on the Site, background checks are conducted only with your separate consent, after a conditional offer of employment has been made. We only retain background check information if we make, and you accept, an employment offer.

Inferences. We may infer information about you and your company from the data we collect, including your likely preferences and product needs.

Sensitive Personal Data. Please do not send us sensitive Personal Data (e.g., government identification numbers, information related to racial or ethnic origin, political opinions, religion, health, biometrics, criminal background or trade union membership) through the Site.

How We Use Your Personal Data

We may record or transcribe video-conference calls in which you participate - for example during sales conversations and requirements discussions - to document your needs, keep accurate records of what was discussed, and improve our services. When a call is audio- or video-recorded, the recording tool is identified as a participant in the meeting or the recording is otherwise announced, giving you the opportunity to object or turn off your camera. We may also use note-taking tools that generate a text transcription or summary of a meeting without recording audio or video. If you prefer not to be recorded or transcribed, let us know at the start of the meeting.

BEEM discloses Personal Data when cooperating with regulatory and government authorities as required by applicable legislation.

Visitors Under the Age of 18

Our Site is a business website intended for professional audiences and is not directed at minors. If you are under 18, please do not submit Personal Data via our forms.

Who We Share Personal Data With

We use third-party service providers to operate the Site, our recruitment and our marketing. They are contractually obligated to protect Personal Data, use it only to deliver the contracted services, not sell it, and not disclose it without our authorization. Where the Personal Data of EU-based individuals is shared, we incorporate the EU Standard Contractual Clauses into our contracts with those providers.

Our recruitment pages use framing techniques to present content from our HR partner (Bamboo HR) while preserving the look and feel of our Site. In that case, you are providing your Personal Data to that third party as well as to BEEM.

We may share Personal Data in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business. In this event, you will be notified of any change in ownership or uses of your Personal Data.

International Transfers of Personal Data

BEEM is a Canadian company using service providers based in the USA. Personal Data will be transferred to the United States and accessed from Canada. Where Personal Data subject to Law 25 is communicated outside Québec, BEEM conducts the assessment required by Law 25 and ensures adequate protection through contractual safeguards. Where Personal Data is processed outside the European Economic Area or the United Kingdom, we rely on Standard Contractual Clauses (Art. 46 GDPR) or another approved transfer mechanism.

Data Security and Retention

Your Personal Data is kept secure. Only authorized employees, agents and contractors bound by confidentiality obligations have access to it. We and our service providers use industry-standard security measures, maintained under BEEM's information security program.

BEEM retains your Personal Data for the period necessary to fulfill the purposes outlined in this Policy or until you request its deletion, unless a longer retention period is required by applicable law. Our retention criteria are the duration of our business relationship with you, plus applicable limitation periods and legal obligations; as a default criterion, prospecting data is retained for 24 months after the last interaction with you. You may request deletion of your Personal Data at any time, subject to legal requirements.

Job applicants. Applications are processed for recruitment purposes only and are retained for a maximum of 24 months, unless you are hired. Background checks are conducted only with your separate consent, after a conditional offer of employment.

Your Options

Marketing communications: click "Unsubscribe" in our emails to stop receiving them. Our commercial electronic messages are sent with your consent (express or implied within the meaning of Canada's Anti-Spam Legislation, "CASL") or in the context of an existing business relationship, with identification of the sender and an unsubscribe mechanism processed within 10 days. Even if you opt out of marketing, we may still contact you about security and privacy issues, account servicing and your requests.

US State Privacy Rights

If you reside in a US state with a comprehensive privacy law (such as California), the following applies. Through the Site, we collect the categories of personal information described above: identifiers, commercial information, Internet or other electronic network activity, and inferences. BEEM does not sell Personal Data for monetary consideration; however, certain advertising technologies used on the Site may constitute "sharing" of personal information for cross-context behavioral advertising within the meaning of California law, in which case you may opt out through the cookie banner or the Global Privacy Control (GPC) signal. Our cookie banner recognizes universal opt-out signals such as the Global Privacy Control.

Subject to applicable law, you have the right to know what personal information we collect, to request its deletion, to request its correction, and to opt out of the "sharing" of personal information for cross-context behavioral advertising. You will not be discriminated against for exercising your rights. You may use an authorized agent to submit a request on your behalf. To exercise these rights, contact privacy@beemdata.com. We respond to requests within 45 days (extendable by a further 45 days where reasonably necessary); depending on your State, you may appeal a refusal, and appeals are reviewed our decision; appeals are reviewed within the following 45 days.

For Individuals Based in the EU, EEA, Switzerland and the UK

If you are based in one of these jurisdictions, BEEM is the controller of your Personal Data collected when you visit our Site and when we process your Personal Data for sales and marketing purposes.

We only process Personal Data on a lawful basis: consent (we ask for your express and informed consent when we rely on it), contract (processing necessary to fulfill our contractual terms with you), or legitimate interest (processing for our marketing purposes, including market research and sales lead generation).
